1. INTRODUCTION AND SCOPE
1.1. Capitalised but undefined terms used in this clause 1 shall have the meaning given to them in clause 2. 1.2. The following terms and conditions of sale (the “Ticket Terms”) set out the general conditions for application, purchase and use of Tickets. Please read these Ticket Terms carefully. 1.3. Any person who applies for, purchases, possesses or attempts to use a Ticket shall be deemed to have accepted and agreed to comply with these Ticket Terms, any Additional Terms, the Venue Regulations and the Applicable Laws. 1.4. Any breach of these Ticket Terms, any Additional Terms, the Venue Regulations and/or any Applicable Laws shall entitle EACV to cancel and invalidate the Ticket and any other Tickets that have been purchased by the Successful Applicant with no right to a refund. Any breach of these Ticket Terms by a Ticket Holder shall result in the Ticket Holder being deemed a trespasser and shall give EACV the right to refuse admission to, or eject, said Ticket Holder from the Venue. 1.5. The Applicant’s attention is particularly drawn to clauses: 4.3 (restrictions on applications), 7 (Ticket use and prohibition on transfers), 8 (Venue entry and requirements), 10 (limitation of liability) and 12 (refunds).2. Definitions and Interpretation
2.1. All capitalised terms used in these Ticket Terms shall have the following meanings: a. “Accessible Ticketing Policy”: EACV’s accessible ticketing policy, including as amended, supplemented or replaced from time to time, published on the Website. b. “Additional Terms”: any additional terms that apply to Tickets obtained via EACV or Authorised Agents, as specified by EACV and/or the Official Ticketing Agent from time to time and communicated to the Applicant, but excluding any other terms or conditions that any third party seeks to impose. c. “Ambush Marketing”: any activity by which a person purports to take advantage of the benefits, goodwill or footfall associated with and generated by the Event, including the unauthorised use of a Ticket as a prize or gift or in a lottery, raffle, sweepstake, fundraiser or competition or for any promotional, advertising or commercial purpose and/or any other activity by a person not authorised by EACV which: (a) associates the person with the Event; (b) exploits the publicity or goodwill of the Event; (c) has the effect (in the reasonable opinion of EACV) of conferring the status of a Commercial Partner on a person who is not a Commercial Partner or otherwise diminishing the status of any Commercial Partner. d. “Applicable Laws”: all laws, statutes, common law, regulations, ordinances, codes, rules, guidelines, orders, permits, tariffs and approvals, including those relating to the environment, health and safety or sanitary measures in the context of epidemics/pandemics, of any governmental authority that apply to the Applicant, Ticket Holder and/or Guest, or the subject matter of these Ticket Terms. e. “Applicant”: any natural person aged 16 years or over with legal capacity to enter into an agreement for the application and/or purchase of Tickets in accordance with these Ticket Terms. For the avoidance of doubt, the term “Applicant” shall apply to any individual who applies for Tickets via EACV or an Authorised Agent. f. “Authorised Agents”: all persons appointed by or on behalf of the EACV from time to time in connection with the Event (including, to the Official Ticketing Agent, hospitality, official travel agents, official partners, sponsors, suppliers, broadcasters and licensees who are legally and contractually entitled to sell or distribute of Tickets). g. “Authorised Person(s)”: Event management, Venue management, police, public bodies and agencies responsible for operations, safety and/or security in connection with the Event, the Venue and/or the Session, and their respective staff, officials, representatives, officers and volunteers. h. “Commercial Partner”: any official event sponsor, official supplier, broadcaster, licensee and/or any other party which has been granted a commercial association with EACV. i. "EA": European Athletics Association, an association established under Swiss law with its domicile at Avenue Louis-Ruchonnet 16 in 1003 Lausanne, Switzerland. j. "Event": European Athletics Championships Birmingham 2026, an event sanctioned by EA. k. “Excluded Person”: any person: (a) refused entry to the Event (or any other event sanctioned by EA); (b) ejected from the Venue (or the grounds of any other EA sanctioned event); (c) banned by an athletics governing body in any jurisdiction in the World; (d) subject to a ban issued by EACV; (e) who has had their accreditation withdrawn by EACV; and/or (f) who has acted in breach of these Ticket Terms (including offering or advertising for sale or transfer, and/or selling or transferring, tickets in breach of EACV’s terms and conditions), any Additional Terms or any terms imposed by an Authorised Agent from time to time. l. "EACV": European Athletics Championships Ventures LLP (Company number OC451782) of 190 Great Dover Street, London, United Kingdom, SE1 4YB. m. “Face Value”: the specified price of the Ticket only (including United Kingdom value added tax thereon) as stated on the relevant Ticket, and excludes any Handling Fee (or part thereof) or other fees or charges paid by the Successful Applicant in respect of that Ticket (including postage or courier charges). n. “Field of Play”: the area within the Venue on which the Event is taking place, together with any adjacent areas required for the purposes of a Session. o. “Force Majeure Event”: any circumstance not within EACV’s reasonable control including: (a) acts of God, abnormally inclement weather, flood, drought, lightning, storm, earthquake or other natural disaster; (b) epidemic, pandemic or infectious disease; (c) terrorist attack, civil war, civil commotion or riots, crowd disorder, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government, public authority, court, competent national authority or governing body, including cancelling a public event, imposing capacity restrictions on a public event, imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent; (f) collapse of buildings, subsidence, structural damage, fire, explosion or accident; (g) athlete strike; (h) death of a member of the royal family; and (i) any labour or trade dispute, strikes, industrial action or lockouts. p. “Guest”: any person for and on whose behalf the Successful Applicant purchased a Ticket and who has obtained such Ticket from the Successful Applicant that must accompany the Successful Applicant at the Session, to whom Tickets may be transferred in accordance with these Ticket Terms. q. “Handling Fee”: the fee payable per Ticket transaction or order, charged in addition to the Face Value of the Ticket, for the processing and delivery of Tickets in that transaction or order (including United Kingdom value added tax thereon). r. “Illegal or Prohibited Item(s)”: those items specified in clause 9.7.b and any other items from time to time prohibited from being brought into the Venue (and Ticket Holders should check the ticketing information on the Website from time to time for details of any additional Illegal or Prohibited Items). s. “Official Ticketing Agent”: any agent appointed by EACV from time to time to sell and distribute tickets for the Event, together with the management of the official resale platform and any ticket box offices. t. “Official Resale Platform”: the website to be operated by the Official Ticketing Agent to enable Successful Applicants to resell Tickets in accordance with these Ticket Terms and any applicable Additional Terms. u. “Original Sale Price”: the specified price of each Ticket plus any Handling Fee (or part thereof) and other charges necessary to affect the sale or trade of that Ticket (including postage or courier charges). v. “Privacy Policy”: EACV’s privacy policy, the current version of which is set out HERE. w. “Purchase Notification”: the notification by email confirming the allocation of Ticket(s) to a Successful Applicant, as sent by EACV or its Authorised Agents. x. “Restricted Item(s)”: any item which, in the reasonable opinion of an Authorised Person, might compromise or otherwise interfere with the enjoyment or comfort of any person at the Venue such as the items referred to in clause 9.7.d and Ticket Holders should check the ticketing information on the Website from time to time for details of any further examples of items which may only be brought into a Venue at the discretion of an Authorised Person. y. “Session”: each athletics session forming part of the Event, the particulars of which (relating to the access that the applicable Ticket provides) are indicated on the Ticket. z. “Successful Applicant”: any Applicant whose application for Ticket(s) has been accepted by EACV in accordance with these Ticket Terms. aa. "Ticket": an Event ticket (whether a hard copy ticket or an electronic ticket) evidencing a personal revocable licence from EACV to the Successful Applicant and subsequently transferred to each Ticket Holder which (subject to these Ticket Terms) grants the Ticket Holder the right to attend a particular Session at the Venue. bb. "Ticket Holder”: any individual who is in actual and legitimate possession of a Ticket, including the Successful Applicant and their Guests (as applicable). cc. “Venue”: Perry Barr's Alexander Stadium, Birmingham including all adjacent and surrounding areas used or controlled by EACV in connection with the staging of the Event. dd. “Venue Regulations”: the regulations detailing the security protocols, prohibited and restricted behaviour, actions and activities, Prohibited and Restricted Items and other conditions of admission that apply to the Venue and attendance of a Session, as may be amended, supplemented or replaced from time to time, and which are published on the Website and a copy or copies of which shall be displayed at or near the entrance to the Venue. ee. "Website": the Event's website at www.birmingham26.com. 2.2. Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular. 2.3. A reference to a statute or statutory provision shall include all subordinate legislation made from time to time under that statute or statutory provision. 2.4. Any obligation on a person not to do something includes an obligation not to allow that thing to be done. 2.5. Any reference to an English legal term for any action, remedy, method of judicial proceeding, legal document, legal status, court, official or any legal concept or thing shall, in respect of any jurisdiction other than England, be deemed to include a reference to that which most nearly approximates to the English legal term in that jurisdiction. 2.6. References to clauses are to the clauses of these Ticket Terms. 2.7. Any words following the terms “including”, “include”, “in particular”, “for example” or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.3. ADDITIONAL TERMS
3.1. Additional Terms (which, for the avoidance of doubt, can only be specified by EACV or its Authorised Agents, from time to time) may apply to the Ticket(s), dependant on the channel via which the Applicant applied for, or Successful Applicant obtained, such Ticket(s), to which each Applicant and Ticket Holder must comply. 3.2. Should there be any inconsistencies between a term in the Additional Terms and a term in these Ticket Terms, the term in the Additional Terms shall prevail.4. APPLYING FOR TICKETS
4.1. Tickets shall not be purchased or obtained from or through any person, commercial agent, company or otherwise than directly by the Applicant from EACV, its Authorised Agents or any third party authorised by EACV to sell or distribute Tickets from time to time. 4.2. By applying for and/or purchasing Tickets, each Applicant warrants that they are not an Excluded Person. Excluded Persons shall not be permitted to make any application for Tickets and any Ticket(s) acquired or used in breach of this clause 4.2 shall be void with no right to a refund and all rights conferred or evidenced by such Ticket shall be nullified. 4.3. The following shall apply to all applications for Tickets: a. An Applicant cannot make an application for more than the number of tickets specified by EACV from time to time during the application process; b. Only one application is permitted per household for each Session; c. Only one application is permitted per credit/debit card for each Session; d. Only one application is permitted per email address for each Session; e. All applications must be made from an Applicant’s permanent address. Applications from hotels, offices, business addresses, student accommodation, temporary accommodation or holiday homes will not be accepted; f. Except in exceptional circumstances (as determined by EACV, acting reasonably), an Applicant is not permitted to change their name, address or email address once an application is submitted; and g. Tickets may not be purchased by any person under the age of 16 years. The nominated payment card or the registered bank account used to purchase Tickets must be registered in the name and address of the Successful Applicant. Any Ticket(s) acquired or used in breach of this clause 4.3 shall be void with no right to a refund and all rights conferred or evidenced by such Ticket shall be nullified. Any person or household submitting multiple applications will have all of their applications voided. 4.4. The Applicant acknowledges and accepts that EACV may use Authorised Agents to sell Tickets. However, and for the avoidance of doubt, EACV shall remain the seller of such Tickets and retain ownership of all rights vesting in such Tickets. 4.5. Tickets (including digital/mobile Tickets) shall remain the property of EACV at all times. 4.6. In an application for Ticket(s), the Applicant is required to provide all information reasonably required by EACV from time to time, which may include their surname, first name, date of birth, postal address and phone number. The Applicant accepts and acknowledges that this information is required for purposes including the facilitation of a Ticket application, identification, health and safety and enforcement of these Ticket Terms. For more information on how the personal data of Applicants, Ticket Holders and Guests will be processed, please see the Privacy Policy. 4.7. If an application for Ticket(s) is successful, any transfer of Tickets to a Guest in accordance with clause 7.3 requires the Successful Applicant to forward the Ticket via email to such Guest(s). If such Guest wishes to accept the transfer of the Ticket, they shall be required to provide all information reasonably required by EACV from time to time. This information is required for purposes including the facilitation of a Ticket transfer, identification, health and safety and enforcement of these Ticket Terms. For more information on how the personal data of Applicants, Ticket Holders and Guests will be processed, please see the Privacy Policy. 4.8. It is the sole responsibility of the Applicant to ensure that: a. an application for Ticket(s) has been filled-in completely and accurately with all required personal details and payment information and properly submitted to EACV in accordance with the instructions specified by EACV from time to time; b. acceptance of these Ticket Terms as required by EACV in the application process is properly given (including by clicking the respective box(es)); c. the Applicant and their Guest (if applicable) understand how their personal data will be processed as detailed in the Privacy Policy. By submitting an application personally and on behalf of each Guest, each Applicant accepts and acknowledges the foregoing (and confirms that each Guest accepts and acknowledges the foregoing). In particular, each Applicant acknowledges (regardless of whether they are allocated any Tickets) that EACV may use any information provided during their application for the purpose of processing such application and for EACV’s enforcement of its legal rights; and d. sufficient funds to cover the Original Sale Price for the Ticket(s) (and any credit or debit card issuing bank fees referred to in clause 5.3) are available on the credit or debit card indicated for payment at the point of payment, and any failure to comply by the Applicant with the requirements detailed in this clause 4.8 will result in the application (and thus such Applicant’s offer to purchase Ticket(s)) being rejected). 4.9. The Applicant warrants that all information provided by them during the application process for any Ticket via any channel is true and accurate (including with respect to their Guests, if applicable). If the Applicant is subsequently found to be in breach of this clause 4.9 EACV shall be entitled to refuse their application or void their Ticket(s) (if it has/they have been issued). 4.10. By completing and submitting an application for any Ticket via any channel (including via any Authorised Agent), the Applicant acknowledges that he/she has read, understood and agrees to comply with these Ticket Terms and any Additional Terms 4.11. Any Applicant who, in the reasonable opinion of EACV, applies for and/or purchases Ticket(s) using any computer software which is designed to afford the Applicant an increased chance of being successful in the purchase of Tickets (such as bots or spiders) shall have any application rejected and/or any Tickets purchased by them cancelled in full, regardless of whether the Applicant has become a Successful Applicant. 4.12. Whilst EACV will attempt to ensure that listings for Tickets on its authorised sites or those of its Authorised Agents are accurate, technical errors may occur. If EACV discovers that an error has occurred which has resulted in an incorrectly confirmed order for Tickets, EACV will inform the Applicant as soon as possible and reserves the right to cancel the Applicant’s purchase. Where possible, EACV will give the Applicant the option of reconfirming their order with the correct details or cancelling their order for a full refund. If EACV is unable to contact the Applicant, the Applicant agrees that EACV may treat the Applicant’s order as cancelled without any liability to EACV and/or the Authorised Agent. 4.13. The agreement between EACV and the Successful Applicant for the purchase of the Ticket(s) will be concluded and confirmed (under these Ticket Terms) only after the: a. successful processing of the credit or debit card payment for the Ticket(s) in accordance with clause 5; and b. acceptance of the Applicant’s offer by EACV by way of sending the Purchase Notification and issuing the Ticket(s).5. PAYMENT FOR TICKETS
5.1. Payment for the Ticket(s) purchased is possible via any other method employed by EACV or its Authorised Agents from time to time. Tickets cannot be purchased with cash or cheques. 5.2. The Applicant acknowledges that by making an application, the Applicant agrees to make payment of the relevant Original Sale Price, provided the requested Ticket(s) are allocated by EACV to the Applicant. 5.3. The Applicant’s credit or debit card issuing bank will apply its own currency exchange rates (if applicable) and may levy additional fees or charges for such transaction. Applicants should contact their respective credit or debit card issuing bank before submitting the application in order to enquire about the relevant exchange rates, charges or fees. EACV and the Authorised Agent shall not be responsible for any such exchange rates, fees or charges levied by the Successful Applicant’s credit or debit card issuing bank. 5.4. Successful Applicants are requested to review their Purchase Notification for any inaccuracies. Any inaccuracies shall be immediately notified to EACV in accordance with clause 13.6. 5.5. The Applicant acknowledges and agrees that all Ticket purchases are final and that (save for circumstances where the provisions of clause 12 apply) no cancellations will be permitted and/or refunds or exchanges given following the submission of an application and successful processing of the Applicant’s credit or debit card payment.6. DELIVERY OF TICKETS
6.1. Subject to clause 6.2, Tickets purchased from EACV (directly or via its Authorised Agents) will be delivered to Successful Applicants via email (which shall be the default delivery method) to the Successful Applicant’s details as specified in the Successful Applicant’s application. 6.2. EACV may use other delivery methods at its sole discretion where reasonably necessary to do so (including delivery of Tickets, in paper form), in particular to ensure efficient and secure delivery of Tickets to Successful Applicants. Hard copy Tickets will be delivered by secure carrier to the billing address of the Successful Applicant and not to any other address unless EACV specifically allows for them to be sent to an alternative address. Post office boxes (or similar) are not acceptable addresses for the delivery of hard copy Tickets. 6.3. If any Tickets have not been received five days before the Event, the Successful Applicant should contact the customer service centre (details of which will be given to the Successful Applicant at the time of the confirmation of sale). 6.4. At the discretion of EACV, Tickets may be made available for collection by the Successful Applicant from the Venue on the day of the Event in which case the Successful Applicant must collect the Tickets in person and will be required to produce the payment card used to purchase the Tickets and photographic proof of identity. If the Successful Applicant does not show the required documents/identification, EACV may refuse to make the Tickets available to the Successful Applicant and will not be responsible for the Successful Applicant’s inability to enter the relevant Session. 6.5. Defective mobile Ticket(s) such as, for example, Tickets not being displayed due to defective mobile phone or insufficient battery, or with incorrect personal information displayed on the Ticket, will be rejected at the entrance to the Venue. Neither EACV or the Authorised Agent shall be responsible for defective, lost or stolen Ticket(s) and will accept no obligation to reissue any such Ticket(s) provided that where there is a defect of a mobile Ticket entirely attributable to EACV, EACV shall, where reasonably possible, cancel the Ticket concerned after notification of the defect and issue a new Ticket to the Successful Applicant upon provision of sufficient evidence from the Successful Applicant. 6.6. Neither EACV or the Authorised Agents shall be responsible for lost, stolen, damaged or destroyed Ticket(s) after their delivery to the Successful Applicant (and, in particular, EACV and the Authorised Agent and shall not be liable to refund any such Ticket(s) or to, where applicable, re-print such Ticket(s)).7. Ticket Use AnD Prohibitions on Transfers
7.1. Ticket Holders are permitted to attend the Session provided that: a. they are not an Excluded Person; and b. the Ticket has been obtained (and applicable, transferred, in accordance with these Ticket Terms). 7.2. Except as expressly permitted in clause 7.3, any resale, transfer of Ticket(s), offer or advertisement of Ticket(s) for resale or transfer, whether for free or for consideration, is strictly prohibited. This prohibition extends to: a. the resale or transfer; b. advertising for sale or transfer; and/or c. providing access to the mobile (or other) device upon which a Ticket is held/displayed for the purpose of reselling/transferring Ticket(s). 7.3. If more than one Ticket is issued to a Successful Applicant, the Successful Applicant must retain one Ticket for their personal use. Any remaining Tickets may only be transferred to Guests provided that: a. the Ticket is for their Guest’s personal use; b. each such Guest is known to the Successful Applicant personally (and did not become known to the Successful Applicant through the sale, transfer or disposal of the Ticket); c. the Guest(s) must accompany the Successful Applicant to the Event; d. any such Tickets must not be offered publicly (including on any website, social media platform or other public forum) whether for sale, as a gift or donation or any other means of transfer and the sale, transfer or disposal e. Tickets must not be for a payment or benefit in excess of the Face Value of the Ticket; f. the Successful Applicant must bring these Ticket Terms and any applicable Venue Regulations to the attention of Guests; g. the sale, transfer or disposal of any such Tickets by the Successful Applicant must be made strictly subject to these Ticket Terms and any applicable Venue Regulations; h. the Successful Applicant must provide the name and address of each Guest when asked to do so by an Authorised Person; i. these Ticket Terms and any applicable Venue Regulations shall be binding upon such Guests in full, save that Guests shall not have any right to sell, transfer or dispose of their Ticket to any other person and only the original Successful Applicant shall have the right to a refund from EACV in respect of such Tickets; and j. the Successful Applicant shall ensure that Guests comply with these Ticket Terms and any applicable Venue Regulations and EACV reserves the right to cancel the Successful Applicant’s own Ticket and refuse the Successful Applicant admission to and/or eject the Successful Applicant from the Venue without refund or compensation in the event of a breach of these Ticket Terms and/or any applicable Venue Regulations by Guests. In the event that any Guest breaches any of these Ticket Terms and/or any applicable Venue Regulations, the Successful Applicant and that Guest shall be held jointly and severally liable for such breach. 7.4. Save for the transfer to Guests pursuant to clause 7.3.e, Tickets can only be resold via the Official Resale Platform. 7.5. Notwithstanding clauses 7.3 and 7.4, it is an essential condition of the issuance of each and every Ticket and the right of admission to the Venue that, the Ticket must not be: a. transferred, used or otherwise disposed of in the course of any business or for the purpose of facilitating a third party’s business; b. transferred, used or otherwise disposed of: i. in relation to any promotional or commercial purpose (including any competition, advertising, promotion, fundraising, auction, raffle or any other similar commercial or non-commercial purposes or as a prize in any contest, competition or game of chance, lottery or sweepstake, whether for a business or a charity or otherwise); ii. to enhance the demand for any other goods or services; c. transferred or otherwise disposed of to any person who agrees to buy any good(s) or service(s) in return for the Ticket; d. transferred, used, combined with, or incorporated as part of any hospitality, accommodation or travel package or service; and/or e. combined with any other good(s) or service(s) (including as part of any hospitality, accommodation or travel package or service), in each case without the prior written approval of EACV. 7.6. Ticket Holders shall not: a. run any advertisements or promotions relating to EACV or the Event; b. advertise, promote, give away, distribute, sell or offer for sale any product or service from any part of the Venue or via the display of overt commercial, promotional or marketing messages on clothing worn or items brought into the Venue; or c. exploit any marketing or promotional opportunities in relation to the Ticket(s). 7.7. Each Successful Applicant assumes full and absolute responsibility for all Tickets allocated to them, including for a breach of clause 7.1 (or a breach of any other provision of these Ticket Terms), whether or not such advertisement, offer for sale or transfer and/or sale or transfer (or other breach of these Ticket Terms) takes place with the knowledge of the Successful Applicant. 7.8. In the event that EACV, the Official Ticket Agent, or any Authorised Person reasonably suspects that a Ticket Holder has obtained their Ticket(s) from an unauthorised source or in breach of these Ticket Terms, the Ticket Holder shall, upon request by EACV, the Official Ticket Agent, or any Authorised Person, give a full explanation as to how and from whom (including full contact details) their Ticket(s) have been obtained and at what price. 7.9. Any Ticket(s) acquired or used in breach of this clause 7 shall be void with no right to a refund and all rights conferred or evidenced by such ticket shall be nullified. Any person seeking to use such Ticket(s) will be deemed a trespasser and will be refused entry or be evicted from the Venue, and may be liable to further legal action. Any unauthorised sale or transfer of the Ticket(s) may be reported to the police.8. Venue Entry and Requirements
8.1. Access to the Venue will be permitted during such hours as specified on the Ticket or as published on the Website. 8.2. Entrance to the Venue shall be: a. subject to compliance with: i. these Ticket Terms; ii. the Venue Regulations; iii. any sanitary measures or polices in place; and iv. all Applicable Laws governing access or presence at the Venue, use of the Tickets, general safety certificate and any special safety certificate applying to the Venue, issued by any authority that has jurisdiction or authority in relation to the holding of the Session at the Venue; and b. authorised upon presentation of the Ticket which shall be displayed on their mobile phone or, where expressly permitted by EACV in writing, a paper Ticket. 8.3. It is the responsibility of the Successful Applicant to retain their Ticket (e.g. their mobile phone which displays the Ticket, if applicable) at all times. Failure to do so may result in the Ticket Holder being evicted from Venue without refund or compensation.9. Conduct at the Venue
9.1. For safety and security purposes, all persons attending the Event, if and when so requested by Authorised Personnel shall: a. produce a valid Ticket together with photograph evidence in order to provide satisfactory evidence that the Ticket Holder’s identity corresponds to that of the Successful Applicant/Guest whose details were provided to EACV; b. comply at all times with the Venue Regulations; c. comply with all instructions and guidelines issued by Authorised Personnel at the Venue; and d. be subject to additional safety controls inside the Venue, as the case may arise. 9.2. The Venue Regulations contain detailed lists of prohibited items and conduct and each Ticket Holder shall fully comply with any restrictions contained therein. 9.3. Without limitation, it is strictly forbidden to do any of the following inside the Venue: a. occupy or access areas which are closed to the public or for which access is unauthorised in accordance with the relevant Ticket type held by the Ticket Holder; b. restrict or loiter in areas open to traffic, footpaths and roadways, entrances and exits to visitor areas and emergency exits; or c. engage in any other conduct which may endanger any person at the Venue. 9.4. If a Ticket Holder fails to comply with the applicable Venue Regulations, they may be refused admission to the Venue or evicted from the Venue without refund or compensation. In the case of any conflict or ambiguity between these Ticket Terms and the Venue Regulations, these Ticket Terms will prevail unless otherwise expressly stated in the Venue Regulations. Notwithstanding the foregoing, EACV and/or the Venue owner reserve the right without prior notice to revoke or vary any of the Venue Regulations with immediate effect if this is considered necessary on public safety grounds. Any such revocation or variation of the Venue Regulations will be displayed as soon as practicable at the Venue and, if appropriate, other sites. 9.5. One Ticket will be required for each person attending the Venue, regardless of age (excluding babies under 2 years old). A valid Ticket permits the Ticket Holder to view the relevant Session from the seat indicated on that Ticket or such other alternative seat as EACV may allocate acting reasonably. Nothing in these Ticket Terms shall constitute or imply any entitlement to occupy the seat indicated on a Ticket at any other event. Ticket Holders are advised to arrive at the Venue and take their seats at least 45 minutes before the advertised start time of the Session. The Ticket Holder is not guaranteed an uninterrupted and/or uninhibited view of the Session from the seat provided, nor is any representation or warranty given as to the quality, content or duration of the Session. Any Ticket Holder leaving a Venue will not be re-admitted and no pass-outs will be permitted. If a Ticket Holder is not 16 years or over, they must attend with their parent(s) and/or guardian(s) who shall also be responsible for their actions, conduct and compliance with these Ticket Terms. 9.6. For the purposes of safety, security and/or checking compliance with these Ticket Terms, each Ticket Holder shall, if requested by any Authorised Person, co-operate and comply fully with the instructions and guidelines of such Authorised Person. A Ticket Holder may be required to submit to a body and possessions search and screen process for the purposes of identifying any Illegal or Prohibited Item or Restricted Item on their person, and any refusal by the Ticket Holder may result in refusal of admission to the Venue or eviction from the Venue without refund or compensation. Any identified Illegal Items shall be handed over to the Police. Any identified Prohibited or Restricted Items which are surrendered by a Ticket Holder as a condition of entry to the Venue shall be deemed to be surrendered irrevocably and voluntarily and will be unable to be reclaimed by the Ticket Holder and shall be disposed of by EACV without liability. 9.7. EACV, and/or any Authorised Person may refuse admission to the Venue or eject from the Venue without refund or compensation any Ticket Holder who: a. is noticeably under the influence of alcohol, narcotics or any behaviour-modifying substance, or is behaving, or considered by any Authorised Person likely to behave, violently, harmfully or in a manner contrary to public order and/or safety; b. brings or attempts to bring into a Venue, possesses or uses within a Venue or in the vicinity thereof any Illegal or Prohibited Item including: i. firearms and ammunition (including component parts) or replica or imitation firearms or ammunition; all types of knives and bladed items; offensive weapons or implements, such as extendable batons, or any items modified into weapons or replica or imitation weapons; controlled drugs; explosives, fireworks, flares, smoke canisters or replica explosive devices; personal protection sprays, laser pointers and strobe lights; glass bottles and glass receptacles (medication bottles for personal use excluded); hazardous and/or toxic materials; cans or any other item that an Authorised Person considers dangerous, hazardous and/or illegal or that may be used as a weapon or a missile or that may compromise or otherwise interfere with the safety of (or pose a hazard to) any person or security at the Venue; ii. phone jammers, radio scanners and walkie-talkies; personal/private wireless and 3G or 4G access points/hubs (smart devices are permitted but must not be used as wireless access points to connect multiple devices); iii. hard cool boxes; iv. compressed gas containers (otherwise than required for personal medical purposes); v. protest material of any kind, including banners, clothing, signs or materials displaying political, religious, offensive or race-related messages, slogans or images; vi. tents, spray paint or any other item which could be used to demonstrate within a Venue, sabotage or damage property; vii. any objects bearing trademarks or other kinds of promotional signs and messages (of whatever nature) which EACV believe may be used for promotional or Ambush Marketing purposes; viii. any tripods or video camera equipment whatsoever (whether or not for personal use); and any camera or other type of photographic or recording device (of any nature whatsoever and whether capturing still or moving pictures) other than for personal use; ix. bicycles, roller-skates, skateboards, scooters, wheeled footwear, and similar items; and x. pets or animals (other than guide/assistance dogs); c. breaches or is reasonably suspected by an Authorised Person of having breached, or being likely to breach, their obligations under clause 11; d. brings or attempts to bring into a Venue, possesses or uses within a Venue any item which, in the reasonable opinion of an Authorised Person, might compromise or otherwise interfere with the enjoyment or comfort of any person at the Venue, such as: large flags, banners and flag poles, oversized hats, large umbrellas, noisemakers such as vuvuzelas and whistles, horns, air horns, drums, rattles, and musical instruments; e. brings or attempts to bring into a Venue any alcohol, food and/or non-alcoholic drinks (unless otherwise specified in the Venue Regulations); f. whilst within the Venue or vicinity thereof, engages in disruptive, dangerous or violent behaviour including: throwing, casting, thrusting or propelling any object (including onto the Field of Play), disseminates any violent, racist, xenophobic, homophobic, insulting, sexist, religious, political or other illegal/prohibited messages, or behaves in a way that any reasonable person may interpret as provocative, abusive, threatening, discriminatory and/or offensive, or creates or poses any threat to the life or safety of themselves or any other person(s), or harms any other person(s) in any way, or unreasonably obstructs the viewing of other spectators; g. enters or circulates in restricted access areas or other areas where that person is not permitted (including the Field of Play, changing rooms or other athletes’ or officials’ areas); or stands on seats; or persistently stands instead of sitting in the allocated seat; or climbs lighting masts, fences, roofs and other apparatus or constructions; h. is reasonably suspected by an Authorised Person of having committed, or being likely to commit, a criminal offence within the Venue or the vicinity thereof; i. enters the Venue with an incorrect age concession Ticket; j. whilst within the Venue or the vicinity thereof, fails to comply with instructions from EACV and/or any Authorised Person; k. whilst within the Venue, damages, interferes with or tampers with any property of any third party; l. whilst within the Venue, smokes or vapes in any area; m. brings or attempts to bring into the Venue, sells, possesses or uses within the Venue or in the vicinity thereof any sponsorship, promotional or commercial items or materials (of whatever nature) without the prior written authorisation of EACV (and the Ticket Holder may be asked to deliver up a copy of any such authorisation upon entry to or whilst within the Venue); n. whilst within the Venue or the vicinity thereof, engages in any form of activity related to marketing or advertising (including, for the avoidance of doubt, Ambush Marketing), or conducts any commercial activity whatsoever, or offers (either for free or for sale), sells or possesses items with intent to sell (including drinks, food, souvenirs, clothes, promotional and/or commercial items and literature), in each case without the prior written authorisation of EACV; o. hangs or drapes any flag or banner over any signage within the Venue; p. engages in any form of gambling, or uses any computer and/or mobile device (including any portable, laptop or handheld computer) to engage in any online betting activities in relation to the result, progress, conduct or any other aspect of the Session, or records, compiles, transmits or disseminates (by any means) any scoring, statistical or other data for the direct or indirect purposes of gambling or gaming; q. offers to any third party any bribe or other reward to fix or contrive in any way or otherwise improperly influence the result, progress, conduct or any other aspect of the Session and/or otherwise contacts or attempts to contact any athlete, coach, team or official for a corrupt or improper purpose; and/or r. is under the age of 16 years unless accompanied by their parent or guardian or another adult who is responsible. 9.8. Ticket Holders are encouraged to travel to the Venue by public transport. Only pre-accredited vehicles will be granted access to the Venue. There is also only limited storage available at the Venue for folding prams and folding children’s buggies.10. Limitation of liability
10.1. Other than is stated in clause 12, EACV shall not be liable for any refund, loss (including indirect or consequential loss), damage or expense caused by a Force Majeure Event. 10.2. Subject to clause 10.6, in the event that EACV is in breach of its obligations (under these Ticket Terms or otherwise), EACV shall only be responsible for such loss or damage suffered by the Ticket Holder which was reasonably foreseeable as a result of the breach. EACV shall not be responsible for any loss or damage that is not reasonably foreseeable or contemplated at the time the Applicant or Ticket Holder (as the case may be) entered into a contract pursuant to these Ticket Terms. 10.3. Subject to clause 10.6 and notwithstanding clause 10.2, EACV is not liable for any business losses and EACV will have no liability to any Ticket Holder for any loss of profit, loss of business, business interruption, or loss of business opportunity. 10.4. Subject to clause 10.6, in any event, to the maximum extent permitted by law, EACV hereby excludes any liability for loss, damage or injury to a Ticket Holder and/or their property, including any indirect or consequential loss or damage, including loss of enjoyment or travel or accommodation costs, regardless of whether the loss or damage: (a) would arise in the ordinary course of events; (b) is reasonably foreseeable; or (c) is in the contemplation of the parties, or otherwise. 10.5. Subject to clause 10.6, EACV shall not be responsible for any interruptions and/or restrictions to the view of any play the Session caused by virtue of: (i) the position of the seat; and/or (ii) the actions of other spectators. 10.6. Notwithstanding any provision in these Ticket Terms, EACV does not seek to exclude or limit its liability: (a) for fraud or fraudulent misrepresentation; (b) for death or personal injury caused by EACV’s negligence or the negligence of any of its officers, employees or agents; or (c) for any other matter for which it is not possible to exclude or limit liability by Applicable Laws (including the Ticket Holder’s statutory rights and rights as a consumer).11. Media and Recordings
11.1. Ticket Holders attending the Event at the Venue, acknowledge and, so far as is necessary under Applicable Laws, consent to being photographed, filmed or taped by EACV, the Authorised Agents and/or Commercial Partners, and/or any third parties appointed thereby, which shall have the right, in perpetuity or for the maximum term permitted under the Applicable Laws, to use, broadcast, publish and license, without any requirement for payment of money or other form of consideration and without credit, the Ticket Holder’s voice, image and likeness by means of live or recorded video and/or audio display, broadcast or other transmission or recording, photographs or any other current and/or future media technologies. 11.2. Each Ticket Holder accepts and acknowledges that it is in EACV’s legitimate interests to use and publish and exploit the content detailed in clause 11.1 in this manner (including any personal data contained therein) as it requires the ability to: (i) publish, display, sell and distribute the Event by means of film, television, radio, print media, internet, publicity material (or any other media now known or in the future); and (ii) use the images for safety and security, promotional, training, editorial or marketing purposes by EACV, as determined in EACV’s sole discretion (including Commercial Partners and accredited media organisations). More information on how EACV processes Ticket Holders’ personal data can be found in the Privacy Policy. Notwithstanding the foregoing, where required under Applicable Laws, each Ticket Holder gives their consent to such use. 11.3. Ticket Holders shall not take, record and/or transmit any sound, image and/or description of the Venue or the Event (as well as any result and/or statistics of the Event) other than for their exclusive, private and domestic use (which, for the avoidance of doubt and by way of example only, shall not include recording and/or transmitting any sound, image and/or description of the Event for any commercial purposes). 11.4. The use of photographic equipment, mobile telephones, computers, tablets or other electronic devices, communication devices, audio-visual equipment or radios must not inconvenience any other person in the Venue or be used to capture, supply or transmit data for the purposes of betting or gambling (or assisting for these purposes). In particular, mobile telephones, computers, tablets or other electronic devices, communication devices, audio-visual equipment or radios must be switched to silent in and around the Venue. Personal headphones must be used when listening to radios inside the Venue. 11.5. Subject to clause 11.6, Ticket Holders acknowledge and agree that EACV is the sole legal and beneficial owner of any intellectual property rights (including copyright and database rights) in any images, footage, data or material taken or recorded in the Venue (including by the Ticket Holder) and the Ticket Holder hereby assigns (by way of present assignment of future rights) any rights he/she may have in respect of such material to EACV and waives all moral rights in the same. Where assignment is not possible under Applicable Laws, the Ticket Holder grants to EACV an exclusive, irrevocable and royalty free licence to use such copyright, database and other intellectual property rights. Ticket Holders further agree (if and whenever required to do so by EACV) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to EACV absolutely and free of all encumbrances and other charges. 11.6. EACV grants each Ticket Holder a licence to use photographs or images taken by that Ticket Holder at the Event for non-commercial use. Save for such permitted use, any persons attending the Event shall not record, use or transmit over the internet, radio, television or any other current or future media, any sound, image, recording or description of the Event, the Venue or any Session (including any results, statistics, information or other data in respect of the Session, whether in whole or in part) or assist any other person(s) conducting such activities. For the avoidance of doubt, still photographs, film, videotape or other audio-visual material recorded within the Venue may not be sold, used or published commercially in any way whatsoever unless authorised by EACV and may be confiscated by EACV if such usage is suspected. 11.7. Recording or transmission in any form of moving images of any part of play at the Event for any purposes is prohibited. 11.8. Flashlight photography is forbidden. 11.9. Betting is prohibited in the Venue at all times.12. Refunds
12.1. No refunds will be given in accordance with this clause 12 where there has been a breach of these Ticket Terms by the applicable Successful Applicant. 12.2. Where the Successful Applicant has validly obtained their Ticket from an Authorised Agent, and such Successful Applicant qualifies for a refund pursuant to this clause 12, such Successful Applicant should contact the specific Authorised Agent to facilitate any such refund. 12.3. EACV reserves the right to change the schedule of the Event from time to time without notice where it is reasonably necessary to do so. The Event is organised and staged in accordance with Applicable Laws and Government guidance in force from time to time and approvals from the Local Authority. No guarantee can be given by EACV that any Session will take place at a particular time or on a particular date, that spectators will be permitted to enter the Venue in any particular numbers, that capacities may not be further reduced after Tickets have been sold, or that the Event will take place at all. All information about times and dates of play is kept as up-to-date as possible but should be taken as a guide only and EACV reserves the right (acting reasonably) to reschedule any Session at any time, without notice and, save as set out in clause 12.7, without any liability whatsoever. 12.4. EACV reserves the right to cancel any Ticket at any time for any operational reasons (EACV acting reasonably in determining this) or as a result of any Force Majeure Event and in the event that EACV exercises this right (including as a result of a postponement of a Session, cancellation of a Session, curtailment of a Session, change of schedule of the Event, or reduction of the number of spectators at the Event), EACV shall have no liability to any Ticket Holder, save as set out in clause 12.7, including for indirect or consequential loss, loss of enjoyment, loss of a chance, loss of time, or travel costs or accommodation costs. 12.5. As soon as possible after EACV becomes aware of postponement, rescheduling or cancellation of a Session, all available information will be posted on the Website, but it is the responsibility of the Ticket Holder to ascertain whether a Session has been postponed, rescheduled or cancelled and any new dates and times. 12.6. A Ticket will not be exchanged or refunded if the: a. Event is stopped for any reason after starting; b. start of the Event is delayed for any reason on the date of the Event; or c. start time of the Event changes but not the date. 12.7. EACV shall only be required to refund a Successful Applicant (on application by the Successful Applicant) with the Original Sale Price of the relevant Ticket, in the following circumstances: a. if the Event is postponed before starting and the Event is not rescheduled; b. if the Event is postponed before starting and the Event is rescheduled to another date (whether at the original Venue or at a different Venue); c. if the Event is cancelled; or d. is otherwise entitled to a refund under English law. 12.8. If an Event is postponed before starting and the Event is rescheduled to another date (whether at the original Venue or at a different Venue), the Ticket Holder may: a. (if the Event is rescheduled to another date at the original Venue) either use the original Ticket for the rescheduled Event or apply for a refund pursuant to sub-clause 12.7.b; or b. (if the Event is rescheduled to a different Venue) either exchange the Ticket with EACV for a Ticket of the same or lower price category for the rescheduled Event (subject to availability of Tickets) or apply for a refund pursuant to sub-clause 12.7.b. 12.9. No interest or costs will be payable in respect of any monies refunded. 12.10. Where clause 12.7 applies, only the original Successful Applicant may apply for a refund. If EACV initiates a refund process under clause 12.7, the Successful Applicant will be advised of the process and the prescribed deadline for refund applications through the media or via direct communication to the contact details provided by the Successful Applicant at the time of purchase of the Tickets within ten working days of the cancellation or rescheduling of the Event or the cancellation of the Event (as applicable). The Successful Applicant must follow the prescribed process and deadline and produce the original Ticket in order to be eligible for a refund. EACV may require the Successful Applicant to return their unused Tickets if they have been dispatched. The Successful Applicant is responsible for ensuring their return and EACV will not be obliged to refund any returned Tickets which it does not receive. Refunds will only be made to the credit/debit card used to purchase the Ticket and no cash refunds will be provided. 12.11. A Successful Applicant does not have a right to cancel their Ticket. However, if the Successful Applicant is a consumer they have legal rights. Advice about Successful Applicants’ legal rights is available from the Citizens' Advice Bureau. Nothing in these Ticket Terms will affect these legal rights.13. General
13.1. Each Applicant consents to these Ticket Terms himself/herself and on behalf of their Guest(s) (i.e. the Applicant shall ensure that their Guest(s) understand(s), agree(s) with and will conform to these Ticket Terms). If the Guest is under the age of 18 each Applicant confirms that they have received proper consent to these Ticket Terms from the Guest(s)’s appropriate parent or guardian under the Applicable Laws. 13.2. These Ticket Terms (together with the Venue Regulations) constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Ticket Terms which is not already set out in these Ticket Terms. 13.3. These Ticket Terms have been drafted in the English language. Translations of these Ticket Terms may be made available by the Authorised Agents. In the case of any conflict or ambiguity between the English language version of these Ticket Terms and any translation of them into any other language, the English language version of these Ticket Terms will prevail. 13.4. In the event that any provision of these Ticket Terms is declared void, ineffective or unenforceable in any respect by any competent court in any jurisdiction, that provision shall be severed to the extent necessary in that jurisdiction, and the remainder of these Ticket Terms will remain in effect as if such provision had not been included and the validity, enforceability and/or legal effect of such remaining Ticket Terms shall not in any way be affected or impaired thereby. 13.5. EACV reserves the right to make amendments to these Ticket Terms from time to time where it has a valid reason to do so, including: a change in the security or public safety requirements of the Venue. A full copy of the latest version of these Ticket Terms (as amended, if appropriate) will be available as part the ticketing information on the Website and, upon request, from EACV at the address specified in clause 13.6. EACV shall notify Successful Applicants of such changes via email to the Successful Applicant’s email address as specified in the Successful Applicant’s application if they materially affect Successful Applicants’ rights as a consumer and the Applicant will have the choice to consent to such material changes or to withdraw their application or withdraw from the agreement concluded with EACV in accordance with these Ticket Terms (as applicable). 13.6. Any information requests or other correspondence in relation to these Ticket Terms should be addressed to: COO, EACV, 190 Great Dover Street, London, United Kingdom, SE1 4YB. 13.7. These Ticket Terms constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Ticket Terms which is not already set out in these Ticket Terms. 13.8. Any person not party to these Ticket Terms shall have no rights under the Contracts (Rights of Third Parties) Act 1999 save that, in addition to EACV, all the provisions of these Ticket Terms shall be enforceable by the Authorised Agents. 13.9. These Ticket Terms are governed by the laws of England and Wales. The parties agree that the courts of London, England have exclusive jurisdiction to settle any dispute arising under or in connection with these Ticket Terms. Notwithstanding the foregoing: (a) these Ticket Terms shall not affect a person’s statutory rights as a consumer and, in particular, if the claimant lives in Scotland they can bring legal proceedings in either the Scottish or the English courts or if they live in Northern Ireland, they can bring legal proceedings in either the Northern Irish or the English courts; and (b) EACV reserves the right to pursue legal proceedings in a competent court of the Applicant’s or Ticket Holder’s (as the case may be) domicile, where such proceedings shall be governed and interpreted in accordance with English law.
